Executive Order No. 0004-2022

IMPLEMENTING GUIDELINES ON ALERT LEVEL 3 IN THE PROVINCE OF PANGASINAN

            WHEREAS, Section 15, Article II of the 1987 Philippine Constitution and Section 16 of Republic Act No. 7160 otherwise known as the Local Government Code of 1991 provide that Local Government Units within their territorial jurisdiction shall promote health and safety of the people;

WHEREAS, due to the nationwide spread of Corona Virus Disease 2019 (Covid-19), the Philippines is declared to be under State of Public Health Emergency and State of Calamity by President Rodrigo Roa Duterte;

WHEREAS, Executive Order No. 151 (s. 2021) issued by President Rodrigo Roa Duterte on November 11, 2021, approved the nationwide rollout of the Alert Level System and adopted the Guidelines on the Nationwide Implementation of Alert Level System for Covid-19 Response (Alert Level System Guidelines) issued by the Inter-Agency Task Force for the Management of Emerging Infectious Diseases (IATF-EID);

WHEREAS, pursuant to IATF-EID Resolution No. 156-C, Series of 2022, the Province of Pangasinan was escalated to Alert Level 3 effective January 14-31, 2022;

WHEREAS, it is necessary to promulgate guidelines on the implementation of Alert Level 3 in Pangasinan, in accordance with the Alert Level System Guidelines in force and pertinent issuances of the IATF-EID and other government agencies;

NOW, THEREFORE, I, AMADO I. ESPINO III, Governor of the Province of Pangasinan, through the powers vested in me by law, do hereby order the following:

PART I – GENERAL GUIDELINES

SECTION 1. MINIMUM PUBLIC HEALTH STANDARDS.

1. MPHS, or mitigation measures for Covid-19 response consistent with DOH Administrative Order No. 2021-0043, shall be implemented at all times. Such measures include but are not limited to wearing appropriate personal protective equipment, maintaining physical distancing, installation of hygiene stations, and ventilation for enclosed areas. Violations thereof are subject to prosecution under pertinent Provincial and local ordinances.

1. The use of face shields shall be voluntary, without prejudice to the continuing mandatory use of face shields in medical and quarantine facility settings and the required use thereof by healthcare workers in healthcare settings.

SECTION 2. CURFEW. There shall be a province-wide curfew from 9 o’clock in the evening to 4 o’clock in the morning.

SECTION 3. REGULATIONS ON MOVEMENT.

1. Unvaccinated individuals or individuals with incomplete vaccinations are strongly advised to stay at home except for emergency or humanitarian reasons.

1. Unvaccinated individuals, especially children below twelve (12) years old shall not be allowed entry to enclosed establishments, including but not limited to malls, supermarkets, and restaurants.

1. Baratillos and fiesta celebrations, especially in public plazas and streets or those sanctioned or sponsored by LGUs, are highly discouraged.

1. In any case, mass gathering activities should avoid catering to those with comorbidities and pregnant women, and those unvaccinated persons especially children below twelve (12) years old.

SECTION 4. BORDER CONTROL.

1. Intrazonal and interzonal movement shall be allowed subject to reasonable restrictions that may be imposed by component LGUs. In any case, the following shall be allowed:
   1. Access to obtain essential goods and services or for work in permitted industries and offices.
   2. Individual outdoor exercises.

1. Should any testing be required by the destination LGU, a valid Covid-19 vaccination card shall serve as sufficient alternative.

1. Pursuant to MMDA Resolution No. 22-01, unvaccinated persons from Metro Manila shall not be allowed entry to the borders of Pangasinan except for emergency and humanitarian reasons.
   1. For this purpose, presentation of vaccination cards in addition to valid IDs shall be required at the borders.
   2. Violation thereof shall be prosecuted in accordance with pertinent provisions of Republic Act No. 11332.

• This prohibition shall be in force and effect until MMDA Resolution No. 22-01 is lifted.

1. All tourists are encouraged to register with Pangasinan Tara Na at https://pangasinan.tarana.ph/

SECTION 5. OPERATING CAPACITIES OF ESTABLISHMENTS.

1. The following establishments and/or activities characterized as high-risk for transmission shall not be allowed to operate, or be undertaken:
   1. Face to face or in-person classes for basic education, except those previously approved by the IATF-EID and/or the Office of the President;
   2. Contact sports, except those conducted under a bubble-type setup as provided for under relevant guidelines adopted by the IATF-EID, Games and Amusement Board, and Philippine Sports Commission, and approved by the LGU where such games shall be held;

• Funfairs/peryas and kid amusement industries such as playgrounds, playroom, and kiddie rides;

1. Venues with live voice or wind-instrument performers and audiences such as in karaoke bars, clubs, concert halls, and theaters;
2. Casinos, horse racing, cockfighting and operation of cockpits, lottery and betting shops, and other gaming establishments except as may be authorized by the IATF-EID, relevant national government agencies, or the Office of the President; and
3. Gatherings in residences with individuals not belonging to the same household.

1. The following establishments, or activities, shall be allowed to operate or be undertaken at a maximum of 30% indoor venue capacity for fully vaccinated individuals only and 50% outdoor venue capacity. Provided that all on-site workers/employees of these establishments, and organizers of activities are fully vaccinated against Covid-19 and MPHS shall be strictly maintained. Provided further, that there is no objection from the LGU where these activities may take place:
   1. Venues for meetings, incentives, conferences, and exhibitions (MICE);
   2. Permitted venues for social events such as parties, wedding receptions, engagement parties, wedding anniversaries, debut and birthday parties, family reunions, and bridal or baby showers;

• Visitor or tourist attractions such as libraries, archives, museums, galleries, exhibits, parks, plazas, public gardens, scenic viewpoints or overlooks, and the like;

1. Recreational venues such as internet cafes, billiard halls, amusement arcades, bowling alleys, skating rinks, archery halls, swimming pools, and similar venues;
2. Cinemas and movie houses;
3. Limited face-to-face or in-person classes for higher education and for technical-vocational education and training;

• In-person religious gatherings; gatherings for necrological services, wakes, inurnment, and funerals for those who died of causes other than Covid-19 and for the cremains of the Covid-19 deceased. In any case, the said gatherings must not exceed three (3) days.
• Licensure or entrance/qualifying examinations administered by their respective government agency, and specialty examinations authorized by the IATF-EID subject to the health and safety guidelines as approved by the IATF-EID;

1. Dine-in services in food preparation establishments such as kiosks, commissaries, restaurants, and eateries, subject to DTI sector-specific protocols;
2. Personal care establishments such as barbershops, hair spas, hair salons, and nail spas, and those offering aesthetic/cosmetic services or procedures, make-up services, salons, spas, reflexology, and other similar procedures including home service options, subject to the sector-specific protocols of the DTI;
3. Fitness studios, gyms, and venues for non-contact exercise and sports, subject to DTI sector-specific protocols. Provided that patrons/clients and workers/employees wear face masks at all times and that no group activities are conducted; and

• Film, music, and television production, subject to the joint guidelines as may be issued by the DTI, DOLE, and the DOH.

1. An additional 10% capacity shall be allowed for establishments that have been awarded Safety Seal Certificates under the Safety Seal Certification Program.

1. Only hotels or accommodation establishments with valid Department of Tourism Accreditation shall be allowed to accommodate guests and clients subject to guidelines issued by the Department of Tourism and the IATF-EID.

1. All other establishments or activities not prohibited may be allowed on-site provided they implement MPHS. Establishments are encouraged to operate minimal on-site capacity thru work-from-home arrangement and other flexible work arrangements.

SECTION 6. PUBLIC TRANSPORTATION

80. Public transport operators in Pangasinan are directed to observe seventy percent (70%) maximum passenger capacity pursuant to LTFRB Memo. Circular No. 2021-076 and Memo. Circular No. 2021-080.

1. Emphasis is made on the strict implementation of minimum public health standards of passengers, drivers, and conductors in public transportation vehicles, such as but not limited to:
   1. Wearing of face masks at all times;
   2. No unnecessary talking and making of phone calls;

• No eating while in transit;

1. Keeping PUVs well-ventilated;
2. Conduct of frequent disinfection;
3. No passengers with Covid-19 symptoms are to be allowed inside any public transportation vehicle;

• Observance of appropriate physical distancing.

SECTION 7. COMPONENT LGUS.

1. Component LGUs are hereby reminded to impose granular lockdowns based on Part II of this Executive Order and in accordance with the Alert Level System Guidelines by the IATF-EID.

1. Component LGUs are encouraged to undertake vaccination efforts by conducting small-scale vaccination drives in barangays. The conduct of information campaigns regarding the vaccines are likewise encouraged.

1. Component LGUs are hereby urged to reactivate their respective isolation facilities in view of the present surge of Covid-19 cases in Pangasinan.

SECTION 8. PENALTIES.

1. Any violation of these Guidelines may be prosecuted under the appropriate local ordinance and/or as non-cooperation of the person or entities punishable under Section 9 par. (d) or (e), as the case may be, of Republic Act No. 11332, otherwise known as the Mandatory Reporting of Notifiable Diseases and Health Events of Public Health Concern Act, and its Implementing Rules and Regulations.

2021. Any individual or establishment who or which will falsify any Covid-19 vaccine card shall be prosecuted under the appropriate local ordinance and/or under Act No. 3815 or the Revised Penal Code, as amended, pursuant to Section 12 of Republic Act No. 11525 or the Covid-19 Vaccination Program Act of 2021.

Part II – IMPOSITION OF GRANULAR LOCKDOWN

SECTION 9. AUTHORITY TO DECLARE. The authority to impose granular lockdown shall be given to the city and municipal mayors with respect to the following:

1. Component barangays, subject to the concurrence of the Regional Inter-Agency Task Force;
2. Individual houses, where one household member has been confirmed;
3. Residential buildings, streets, blocks, puroks, subdivisions, and/or villages within their jurisdiction.

SECTION 10. PARAMETERS TO DECLARE. The parameters in declaring Granular Lockdown shall be based on NTF-CV Memorandum Circular No. 2 and the Alert Level System Guidelines in force.

SECTION 11. MOVEMENT DURING LOCKDOWN. Movement within, into, and out of the area under granular lockdown shall only be allowed to healthcare workers (HCWs) and non-health personnel working in hospitals, laboratories, dialysis facilities, and community healthcare workers if their institutions are unable to provide accommodation for their personnel, and uniformed personnel tasked to enforce the granular lockdown, as well as:

1. Outbound Overseas Filipino Workers and those returning to their residences after completing facility-based quarantine;
2. Returning residents, who must thereafter remain therein for the duration of the granular lockdown;
3. Individuals under exceptional circumstances, such as those seeking urgent medical attention as validated by the municipal/city health officer;
4. Food and essential items provided that they can only be picked up and/or unloaded at border collection points designated by the LGU.

SECTION 12. SEPARABILITY CLAUSE. Should any provision of this Order be declared by a court of competent authority as invalid or unconstitutional, the remaining provisions not adversely affected thereby shall remain in full force and effect.

SECTION 13. EFFECTIVITY CLAUSE. This Order shall take effect immediately until or unless subsequently amended/revoked/revised. All orders, rules, regulations, promulgations, circulars, and/or issuances by the IATF and/or concerned national government offices/agencies are hereby adopted. All previous issuances of the undersigned and/or by component LGUs, which are not in contravention of the IATF Resolutions and/or its member agencies shall be made applicable in a suppletory manner.
